Article 1: General Provisions

The e-commerce website of artofsense.com, established in Antwerp, Belgium, VAT BE0801.658.973, offers its customers the opportunity to purchase products from its webshop online.

These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”). Placing an order via the artofsense.com webstore implies that the customer has consulted these conditions and expressly accepts their applicability, to the exclusion of all other conditions.

Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other duties or taxes required by the customer.

If delivery, reservation, or administrative costs are charged, this will be stated separately. The price statement refers exclusively to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer are not binding on artofsense.com.

If the customer has specific questions about sizes, color, availability, delivery time or delivery method, we request that the customer contact our customer service in advance at contact@artofsense.com.

Article 4: Online Purchases

The customer can choose between the following payment methods:

ART OF SENSE is entitled to refuse an order (in writing) due to a serious shortcoming of the customer regarding the order or any other agreement in which the customer is involved.

Article 5(a): Delivery and Performance of the Agreement

Goods that are in stock will be sent on Monday evening and Thursday evening after receipt of payment. Articles ordered through this webshop are delivered in the BENELUX, France, Germany, and Europe.

Delivery is made via BPOST or Post.nl. Unless otherwise agreed, the goods are delivered to the customer’s place of residence within 30 days of receipt of the order.

Any visible damage and/or qualitative shortcoming of an article or other shortcomings in the delivery must be reported immediately by the customer with a photo to contact@artofsense.com.

The risk due to loss or damage passes to the customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods.

Article 6: Retention of Title

The delivered items remain the exclusive property of ART OF SENSE until full payment by the customer.

Article 7: Right of Withdrawal

The provisions of this article only apply to customers who purchase items online in their capacity as consumers.

The customer has the right to withdraw from the agreement within a period of 14 calendar days without stating reasons. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer takes physical possession of the good.

In order to exercise the right of withdrawal, the customer must inform ART OF SENSE of his decision to withdraw from the contract by an unambiguous statement (e.g. in writing by post or e-mail to contact@artofsense.com).

The customer must return or hand over the goods without delay, but in any case no later than 14 calendar days after communicating his decision to withdraw from the agreement to ART OF SENSE.

The direct costs of returning the goods shall be borne by the customer.

If the returned product is in any way diminished in value, ART OF SENSE reserves the right to hold the customer liable and claim compensation for any loss in value of the goods resulting from use that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned.

If the customer withdraws from the agreement, ART OF SENSE will refund all payments received from the customer, including standard delivery costs, within a maximum of 14 calendar days after being informed of the decision to withdraw. ART OF SENSE can withhold reimbursement until it has received all the goods back, or until the customer has demonstrated that he has returned the goods, whichever comes first.

ART OF SENSE refunds the customer with the same payment method with which the customer performed the original transaction; in any event, the customer will not be charged for such reimbursement.
